The appellant had declared the value as Rs. 14,000 USD (FOB), which comes to declared assessable value of Rs. 12,36,992.72. The duty payable on such declared value comes to Rs. 3,64,183/-. The subject goods were recommended for first check examination. Subsequently, the matter was transferred to SIIB (Import). On further examination into the matter, the assessable value of the impugned goods was re-determined i.e. for frames (assorted) as Rs. 121/- per piece and for sun glasses (assorted) at Rs. 135/- per piece. .... the invoice dated 17.02.2016, the appellant had filed the bill of entry and declared the value of the goods as per the said invoice. He further submits that in respect of the invoice value of 14,000 USD, the appellant had paid 2,500 USD on 02.11.2015 and the balance amount was paid subsequent to supply of the imported goods. Thus, it is his submission that the entire invoice amount was paid to the overseas supplier through approved banking channel and over and above such amount, the appellant had not paid any amount for the importation of the goods.
