The ambit and scope of section 39(5) of the Act and a similar provision contained in section 20(5) of the Punjab General Sales Tax Act, 1948 was considered by a Full Bench of this court in Emerald International Ltd. v. State of Punjab [2001] 122 STC 382; (1997) (2) 116 PLR 797.
