      Chhattisgarh Goods and Services Tax (Ninth Removal of Difficulties) Order, 2019
      Summary: Clarifies that for appeals under subsection (1) of section 112 the three month period, and for applications under subsection (3) the six month period, shall start from the later of the date the order is communicated or the date on which the President or State President of the Appellate Tribunal, after its constitution under section 109, enters office.

      Format on Statement of Deviation or Variation for proceeds of public issue, rights issue, preferential issue, Qualified Institutions Placement (QIP) etc.
      Summary: Listed entities must submit a standardized Statement of Deviation or Variation in the Annex A format quarterly, describing deviations in use of proceeds and category-wise variations between projected and actual utilisation, reviewed by the audit committee (or Board if no audit committee), with committee comments and any auditor remarks filed with stock exchanges; disclosures are required until proceeds are fully utilised and must accompany quarterly financial results within prescribed timelines.

      Guidelines for filing of placement memorandum - InvITs proposed to be listed
      Summary: InvITs issuing units by private placement and proposing to list must file a draft placement memorandum with the Board and stock exchange(s) through a registered merchant banker at least thirty days prior to opening; the draft must include Schedule III disclosures and be accompanied by a Form A due diligence certificate, the Board will issue observations within fifteen working days counted from the latest of several specified events, and the merchant banker must incorporate comments and provide a Form B due diligence certificate before final filing.

      Framework for listing of Commercial Paper-Amendments
      Summary: Amendments allow listed issuers compliant with SEBI LODR and issuers with outstanding Commercial Paper compliant with Annexure II to file unaudited financials with limited review for a stub period, subject to disclosures including risk factors. Issuers required to prepare financials for consolidation into a parent's consolidated results may submit either the prescribed standalone financial results or the quarterly results prepared for consolidation. The circular is issued under SEBI authority and posted on SEBI's website.

      Investment in units of Mutual Funds in the name of minor through guardian and ease of process for transmission of units
      Summary: Payments for investments in a minor's mutual fund account must come only from the minor's bank account or a joint minor guardian account; on majority the investor must provide updated KYC and bank details and transactions are suspended until status is updated. AMCs must suspend SIP/STP/SWP standing instructions on attainment of majority and employ image based processing, common transmission and NOC forms, a uniform document set and a standard unclaimed funds process for transmission claims, with AMFI prescribing mandatory templates and procedures.

      Summary: Services by State Governments granting alcoholic liquor licences for licence or application fees are treated as neither a supply of goods nor a supply of service under a State notification implementing GST Council recommendations; this special dispensation is limited to State grants of liquor licences and does not apply to other licences or privileges where GST continues to be payable.

      Summary: The explanation excluding Government and Local Authority activities from the term 'business' at entry 3(vi) of notification No. 11/2017 STR is effective from the inception of that entry (21.09.2017) because it was inserted under the statutory power to add explanations within one year, and the later-stated operative date in the subsequent notification does not affect this retrospective operation.

      Clarification regarding taxability of supply of securities under Securities Lending Scheme. 1997
      Summary: The lending fee charged by a lender under the Securities Lending Scheme, 1997 constitutes consideration for a taxable supply of service and has been subject to GST since 01.07.2017; intermediaries' facilitation services are also taxable. The supply is classifiable under heading 997119 at 18% GST. For 01.07.2017-30.09.2019 the lender bears IGST liability (subject to credit for any CGST/SGST/UTGST already paid); with effect from 1 October 2019 the borrower is liable to pay IGST under the reverse charge mechanism.

      Clarification regarding determination of place of supply in case of software/design services related to Electronics Semi-conductor and Design Manufacturing (ESDM) industry
      Summary: When testing on recipient provided prototype hardware is an ancillary activity to a composite supply of software and chip design, the place of supply for the composite service is the location of the service recipient; the separate rule for goods made physically available by the recipient does not apply independently to determine place of supply for such ancillary testing.

      Clarification on applicability of GST exemption to the DG Shipping approved maritime courses conducted by Maritime Training Institutes of India
      Summary: Services supplied by Maritime Training Institutes conducting Director General of Shipping approved maritime courses qualify as educational institution services eligible for GST exemption under the State Tax notification, provided the education is part of a curriculum for obtaining a recognised qualification and the conditions of the notification are met; this follows from the Merchant Shipping Act and the STCW Rules empowering DG Shipping to approve courses, assessment programmes and institutes.

      Standard Operating Procedure to be followed in case of non-filers of returns
      Summary: Where a registered person fails to furnish a statutory return, issue FORM GSTR-3A electronically requiring return within fifteen days; if the return remains unfurnished the proper officer may make a Best Judgment assessment and issue FORM GST ASMT-13, upload the summary in the recovery form, and rely on outward supply statements, auto populated data, e way bills or inspection material. A valid return filed within the prescribed cure period after service of the assessment order will deem the assessment withdrawn; otherwise recovery and protective measures including provisional attachment and registration cancellation may follow.

      Generation and quoting of Document Identification Number (DIN) on any communication issued by the officers of the Central Board of Indirect Taxes and Customs (CBIC) to tax payers and other concerned persons
      Summary: All communications by any CBIC office to taxpayers and concerned persons must carry an electronically generated Document Identification Number (DIN), produced via the enhanced DDM online platform, enabling online verification, creation of a digital audit trail and standardized, prepopulated DIN-bearing templates for search authorisations, summons, arrest memos, inspection notices and provisional release orders; communications lacking an electronic DIN (except as previously exempted) are to be treated as invalid and deemed never issued.

      Generation and quoting of Document Identification Number (DIN) on any communication issued by the officers of the Central Board of Indirect Taxes and Customs (CBIC) to tax payers and other concerned persons
      Summary: Generation and mandatory quoting of a Document Identification Number (DIN) is required on all communications (including e mails) by any CBIC office from 24.12.2019; the cbicddm.gov.in portal has been enhanced for electronic DIN generation and online verification. Communications lacking an electronically generated DIN, and not covered by exceptions in Circular No. 37/2019, shall be treated as invalid and deemed never issued unless regularised as per the stated procedure. Chief Commissioners/Director Generals must circulate these instructions and report implementation difficulties.
