      Summary: Point of taxation in service tax is governed by the Point of Taxation Rules, 2011 which make the earliest of the date of provision, the date of invoice, or the date of payment the point of taxation. Judicial authorities hold that the taxable event is the rendering of service and that the rate and liability are determined by the time of provision; invoices raised before a rate change fix the point of taxation when payment follows, and belated payments do not alter the rate applicable at provision.

      Summary: Section 44AD permits an eligible assessee in an eligible business to deem profits at eight per cent of total turnover or gross receipts, treats certain deductions and depreciation as already given effect to, excludes Chapter XVII C for the eligible business, and allows limited partner deductions for firms. Where claimed profits are lower than the presumptive rate and total income exceeds the basic exemption, audit and audit report are required. Sub section (6), inserted by amendment, excludes professions, commission/brokerage income and agency businesses from the section's applicability.

      Summary: The Commissioner extends the last date for online filing of second quarter VAT returns for 2013-14 in Forms DVAT 16, DVAT 17 and DVAT 48 with required annexures and provides a later date for submission of the hard copy returns with enclosures; tax payment procedures remain as previously prescribed.

      Uniform list of services to be followed in SEZs — regarding.
      Summary: The Department of Commerce has expanded the SEZ uniform default authorised services list to include Rent a cab Scheme Operator's Services and SEZ Online Services. Unit Approval Committees are to ordinarily permit the approved uniform list as default authorised services unless contrary reasons arise; services not included in the uniform list remain subject to UAC decision on merit. Development Commissioners and UACs may further expand the list to facilitate units and developers in their zones.
