      By: Dr. Sanjiv Agarwal
Summary: Alleged failure to pass on the benefit of Input Tax Credit was examined by comparing pre and post GST invoices, dealer margins, trade discounts and landed prices; the post GST base price to the purchaser was lower and available ITC had increased, resulting in a reduced overall dealer margin, and on this factual basis the allegation that the ITC benefit was not passed on was not established.

Summary: Sections 269SS, 269ST and 269T mandate non-cash modes for acceptance, receipt and repayment of specified sums (including advances relating to immovable property) and permit limited exemptions; section 271D imposes a penalty equal to the amount accepted in contravention of section 269SS. The article argues that the strict penalty and mode restrictions may discourage truthful disclosure and unintentionally sustain black-money circulation, suggesting legislative modification to incentivise disclosure while enabling the tax administration to trace and tax counterparties.

Summary: An online lending portal majority owned by public sector banks and financial institutions was launched to accelerate in principle loan approvals to MSMEs by enabling borrowers to access multiple banks via a FinTech platform, using data driven credit assessment consistent with banks' approved credit policies and including a prima facie check for CGTMSE credit guarantee; this complements government and RBI measures to expand MSME credit through directed lending targets, allocation to micro accounts, simplified working capital norms, specialised branches, and market mechanisms such as TReDS, while banks continue to lend on commercial terms under their board approved policies and RBI guidelines.
Summary: Total indirect tax collection for April-November 2018-19 is reported inclusive of central components and the GST Compensation Cess, with the full year Budget Estimate stated and final annual receipts to be established after year end. The Government has implemented administrative measures-GST rate rationalization, mandatory e filing and e payment, penalties for delayed payment, use of third party data for compliance verification, enforcement actions and taxpayer education-to meet the revenue target.
Summary: Repayment of 6.05% Government Stock 2019(Feb) is repayable at par on the effective date with no interest accrual from the scheduled repayment date; if a State holiday falls on that day, paying offices in that State will repay on the previous working day. Payment to registered holders under sub regs 24(2) and 24(3) of the Government Securities Regulations, 2007, will be by pay order with bank particulars or by electronic credit, and holders must submit bank account details in advance; absent such particulars, holders may tender duly discharged securities at designated paying offices 20 days before the due date.
Summary: Rationalization of service tax rates was effected through GST Council decisions and corresponding legislative amendments; amendment Acts received presidential assent and were to be brought into force by the Central Government with implementation through notifications and circulars that give effect to Council-recommended rate reductions for specified service groups.

Seeks to impose anti-dumping duty on imports of ''Methylene Chloride" originating in or exported from European Union and United States of America
Summary: The designated authority found continued dumping of Dichloromethane from the European Union and the United States causing injury and price undercutting, and recommended definitive anti-dumping duties. The Central Government imposed differentiated per-unit duties by reference to origin/exporter/producer combinations, expressed in US Dollars per kilogram, effective for a fixed five-year period and payable in Indian currency using the government-specified exchange rate applicable on the bill of entry date.

      Press Note 1 (2019)
Summary: The Press Note designates specific defence platforms and equipment that require an industrial licence under the Industries (Development and Regulation) Act, 1951, and identifies arms, ammunition and related materials that require a licence and Form-VII approval from DIPP for manufacturing and/or proof-testing under delegated powers from the Arms Act; it centralises licensing authority, defines covered categories and notes limited technical exclusions.

      Press Note No. 2 (2018 Series) - dated 26-12-2018
Review of the policy on Foreign Direct Investment (FDI) in e-commerce
Summary: The policy permits 100% FDI under the automatic route only in marketplace models and prohibits FDI in inventory based e commerce; e commerce entities must operate on a B2B basis, not B2C. Marketplace entities must not own or control vendor inventory (control is deemed if over 25% of a vendor's purchases are from the marketplace or its group), must not influence sale prices, must provide vendor services on an arm's length, fair and non discriminatory basis, and must ensure payments conform with Reserve Bank guidelines. Entities with equity participation by the marketplace or its group cannot sell on the same platform.

Clarification in respect of "not permitting" the import of the capital goods required for "distribution of electrical energy (power)" under the EPCG Scheme
Summary: Clarification confirms EPCG authorisations do not permit import of capital goods for activities relating to the supply of electrical energy; transmission and distribution are treated as the same supply process, and Sr. No. 12 in Appendix 5F of FTP 2015-20 excludes capital goods for generation, transmission and distribution from EPCG eligibility.

      66/2015-20 - dated 3-1-2019
Rationalization of procedures in handling redemption requests under Advance/EPCG Authorizations
Summary: Applicants seeking redemption under Advance and EPCG authorizations must declare the number of EDI Shipping Bills and the number of Non-EDI Shipping Bills on amended ANF-4F and ANF-5B; the Public Notice inserts a new declaration item in each form so that the forms explicitly capture the composition of shipping bills submitted in support of redemption requests.
