Undertrial delay detention, MBBS/BDS quota changes, auction cancellations, PMLA challenge, chargesheet cognisance stay, cybercrime account-freeze SOP
The Supreme Court held that prolonged incarceration of an undertrial without commencement or reasonable progress of trial is impermissible because it effectively converts pretrial detention into punishment, strengthening scrutiny of delay-based detention. It held that admission criteria for MBBS/BDS courses cannot be altered once the admission process has begun, thereby restricting midstream changes to quota procedures. It clarified that an auction process cannot be discarded merely because the conducting authority expected a higher bid, limiting arbitrary cancellation of auctions. It dismissed a challenge to a provision of the PMLA by an accused and directed that the accused face trial, thereby maintaining the provision's enforceability in that proceeding. It extended an order restraining a trial court from taking cognisance of a chargesheet, continuing the procedural standstill. It agreed to examine a plea seeking a uniform SOP for freezing and de-freezing bank accounts during cybercrime investigations, potentially prompting RBI/Centre action.
