<h1>Undertrial detention in economic offence cases without trial progress, with documentary evidence already filed; bail granted with conditions.</h1> Prolonged incarceration of an undertrial without commencement of trial or reasonable progress was held impermissible as it effectively converts pretrial detention into punishment; continued custody in such circumstances, particularly where evidence is primarily documentary and already with the prosecution, violates the Article 21 right to a speedy trial, and statutory restrictions cannot justify indefinite pretrial detention. Economic offences were clarified not to constitute a homogeneous class warranting blanket denial of bail; bail must be assessed case-by-case with reference to gravity, prescribed sentence, object of the special statute, and attending circumstances. Applying these principles, the Supreme Court set aside the High Court's bail refusal and granted bail, subject to conditions including furnishing a contact number, surrendering passport, and travel restrictions without trial court permission.
