Limits on summoning lawyers for client information; Section 132 protects advocates, device seizure allowed only with prior legal authorization
The Supreme Court set aside Enforcement Directorate summons issued to two senior lawyers and issued guidelines limiting probe agencies from summoning advocates for information about clients except where authorised by law, specifically the exceptions in Section 132 of the Bhartiya Sakshya Adhiniyam, 2023. The court held such summons risk infringing the fundamental rights of accused persons who retain counsel. It ruled that lawyers' digital devices may be seized only with prior court authorization, and accessed in the lawyer's presence and that of parties after objections are overruled. The judgment aims to protect the legal profession from undue investigative pressure.
