The assets were part of earlier ED attachments that were vacated during an NCLT-approved resolution plan in which the ED was not impleaded; subsequent litigation reached the Supreme Court, which, while reserving questions of law and noting its order is not precedent, directed restitution under Section 8(8) of the PMLA to benefit genuine homebuyers.
