<h1>Restraint on promoter and realty subsidiary from alienating project; promoter must cooperate with IRP; hybrid resolution recommended</h1> The Supreme Court restrained a realty subsidiary and its suspended promoter from alienating or creating third-party rights in a mixed-use Noida development while insolvency proceedings continue, and impleaded the local development authority. The court directed the suspended promoter to cooperate fully with the interim resolution professional (including supplying records and soft copies to the IRP and amicus), allowed interlocutory applications by homebuyer groups, and permitted responses to the amicus report. The amicus recommended a court-monitored hybrid resolution mechanism, displacement of promoter control, a forensic audit, appointment of a new board and project management consultant, and the matter was listed for further hearing.
