Alleged sexual assault and torture of 17-year-old in police custody; petition sought POCSO and Juvenile Justice Act remedies
A petition alleging that a 17-year-old was unlawfully detained, sexually assaulted and tortured in police custody, not produced before the juvenile board or magistrate within 24 hours, and not medically examined sought court-monitored investigation, formation of an independent SIT or CBI probe, AIIMS medical board examination and FIR registration under POCSO, the Juvenile Justice Act and other penal provisions. The Supreme Court declined to entertain the plea, refused to direct AIIMS, and asked the petitioner to approach the high court under Article 226, permitting return if the high court fails to act; it noted preservation of CCTV evidence should be sought timely.
