Presiding officer's challenge to suspension over alleged misconduct, ex parte disposals and adjournments dismissed after inquiry and report
A presiding officer of a Debts Recovery Tribunal challenged an order extending his suspension; the Supreme Court dismissed his plea after the Delhi High Court had likewise rejected his challenge. The officer was appointed in 2022 but faced multiple complaints from the DRT Bar Association alleging improper behaviour, repeated ex parte disposals and adjournments defeating the statute's purpose. Complaints were referred to the appellate tribunal chairperson, a preliminary report noted misconduct, and a search-cum-selection committee recommended suspension following an inquiry. Suspended in February 2024 with extensions, the officer argued he was penalised for strict case management; courts were unpersuaded and dismissed his challenge.
