The case number 43/2010 on Modular Operation Theatres is under the adjudication in the Competition Commission of India (CCI) which is a quasi judicial body. Companies found indulging in bid rigging, cartelization and other fraudulent means thereby adversely affecting the Competition would be dealt with appropriately under the relevant provisions of the Competition Act, The Competition Act has sufficient provisions to penalize companies indulged in bid rigging and cartelization.
The question of Government proposing to hand over the case to CBI regarding CCI findings in the case of Safdarjung Hospital Sports Injury Centre does not arise.
The Minister of State for Ministry of Corporate Affairs Shri R.P.N. Singh gave this information in a written reply in Rajya Sabha today.

Bid rigging and cartelization: companies may be penalized under competition law following regulatory adjudication process. Companies alleged to have engaged in bid rigging and cartelization are subject to the Competition Act's adjudicatory framework, which empowers regulatory determination of anti competitive conduct and imposition of penalties. The Government indicated that enforcement will proceed within that statutory regime and that no separate handover to external investigative agencies is being pursued in the related Safdarjung Hospital matter.Press 'Enter' after typing page number.
