Relevance Default Date
March 9, 2026   Case Laws Money Laundering
Prima facie money laundering found; provisional attachment upheld but limited to quantifiable illicit proceeds, not full contract value.
Finality of higher-court orders prevents lower-court actions that prejudice beneficiaries; non-parties retain remedies to challenge effects.
Writ interference in disciplinary proceedings limited: prima facie attribution defect justified supervisory directions for expeditious, fair inquiry.
Reporting obligations expanded to cover electronic money, CBDC and crypto assets, adding definitions and new due diligence and reporting fields.
Risk sharing support for MSME exports to under served markets enabling non recourse trade finance with score based cover and exposure caps.
Credit assistance for e commerce exporters: pilot guarantees and interest subvention to expand MSME export working capital access.
Supply Chain Resilience: IMG established to monitor disruptions, assess vulnerabilities and coordinate mitigation with stakeholders.
Shifting Registered Office: pendency of appeal without a stay does not prevent the Regional Director permitting relocation under Rule 30(9).
Input Tax Credit availability must trigger distribution only when legal entitlement arises, not merely on invoice issuance.
Statutory Appeal Right preserved; 30 day stay allowed, perishable goods to be auctioned and proceeds held pending appeal.
Consolidation of tax periods is impermissible; year wise assessment and limitation must be preserved despite fraud allegations.
Omission of statutory rule removes legal basis, so recovery orders issued solely under that rule were set aside.
Reliance on Precedent must be verified; unverified or AI generated citations can vitiate orders and require regulatory parameters.
Duty to consider material submissions: authority must afford hearing, pass a reasoned order and reconsider refund eligibility.
Natural Justice breached by non-service and no hearing; adjudication quashed and matter remitted for fresh, speaking reconsideration.
Mandatory DRC-07 summary preserves appellate rights-issuance directed to enable appeal; penalty challenge barred once proved or paid.
Right to Travel Abroad upheld; court permits travel subject to security deposit, itinerary disclosure and passport production.
Entitlement to Input Tax Credit requires reconsideration after statutory insertion, remand and conditional relief on compliance.
Limitation for TDS: each quarterly statement triggers an independent two-year limitation period, not an annual cumulative computation.
Relief for arrears can be claimed in addition to voluntary retirement exemption; AO instructed to verify and recalculate relief.

Companies Law May 9, 2026 Case Laws HC
Section 536(2) was construed as making post-petition dispositions voidable rather than automatically void, so the court could validate a bona fide transaction if it benefited the company or creditors. The first transaction was validated because the applicant showed no knowledge of the winding-up petition despite due diligence, paid above market value, used the proceeds to discharge creditors, and no fraud, taint, or undervaluation was proved. Alleged statutory dues did not defeat validation on the material before the court. The second transaction, being a private inter se transfer, was held outside the scope of the application and was not adjudicated.
