IS IT COMPULSORY TO AMEND REGISTRATION

RAM SHARMA

Dear Experts,

As per notification 48/2012 dt. 30/11/12 of relocate new service code for deposit service tax. Is it compulsory for amend service tax registration. Pl advice.

Thanks

Service tax registration amendment required to reflect relocated service code; electronic system update may delay compliance. Notification No. 48/2012 and the revised Form ST-1 incorporate the relocated service code for deposit services; taxpayers registered under the negative list regime must obtain an amendment of their service tax registration from the jurisdictional Central Excise/Service Tax department. Practical difficulty arises because the ACES system has not been updated to allow electronic amendment and presently shows only the consolidated 'other than negative list' category. (AI Summary)

Yes, it is veryd much incorporated in the Notification No. 48/2012-ST and Form ST-1 do also consisting of such positive list code for the specific services.

If you had applied for ST Registration under Negative list regime then you would have to get it amended from the jurisdictional CE/ST Department.

As advised by learned Mr Pradeep, it is essential to get the Regn amended. But the unfortunate part is that ACES is still not updated to amend the registration. Even now we can see only one category in the list, ie, " Other than negative list"
