Service Tax on Renting of Commercial Property

Dipak Dave

Service Tax  made payable on Renting of Commercial Property w.e.f. 01-June-2007.

Thereafter, there were several litigations and diferrent opinions by Various High Courts and the matter was pending with Supreme Court - But till such time it is finally decided, nothing has changed!!

Is there anybody who can guide me the recent development on this please?

Supreme Court undecided on service tax for commercial rentals; pay under protest advised. Retailers must comply with payment orders. A query was raised regarding the service tax on renting commercial properties, which has been applicable since June 1, 2007. Despite ongoing litigation and varied opinions from High Courts, the Supreme Court has yet to make a final decision. A reply advised paying the tax under protest until the issue is resolved. A trade notice from the Commissioner of Service Tax, Mumbai, referenced a Supreme Court order requiring members of the Retailers Association of India to pay 50% of arrears and provide surety for the remainder. Compliance details and solvency certificates are required for adherence to the court's directive. (AI Summary)
