Manufacturer Faces Issues with Electronic Filing of ER-1 Form; Timely Manual Submission Suggested if Technical Errors Occur. A manufacturer faced issues filing the ER-1 form electronically due to technical errors on the ACES site and was advised by customer service to submit a hard copy to the Range Superintendent, who refused it. Respondents suggested using the online facility for immediate acknowledgment and checking the status if using offline methods. They emphasized that the Range Office cannot refuse a hard copy if submitted within the deadline, though they may reject late submissions. Filing electronically is mandatory, and failure to do so may lead to a show cause notice, but timely manual submission with a valid reason should be accepted. (AI Summary)

Dear Sir,

You might be using offline facility at aces website. Instead, use onlile facilty at aces for filing ER-1. Immediately, it gives the acknowledgement that ER-1 has been submitted along with acknowledgement slip. Kindly keep its print out

In case if you are using offline (upload facility), then check the status at the interval of 3 to 4 hours. It will give you idea whether your return has been accepted or not.

Sometimes it happens that ER-1 is not filed online due to some technical problem. But if it is not accepted online that means that ER-1 is not filed. You have mentioned that you tried to submit hard copy of the ER-1 in the Range Office but the officers refused to accept. The Range Office cant refuse to accept hard copy, yes this may happen that you could have approached the Range Office after the stipulated time i.e. 10th day of the next month and asked them to accept it on the earlier dated as if it is submitted in time because youu could not file it electronically due to technical problem. If this  is the situation the Range Officer is free not to do that. But if you have approached the Range office within the stipulated time limit he cant refuse to accept the hard copy. Not filing ER-1 electronically by the assessee who is required to that is an offence, but for this Range Office will have to issue a show cause notice and you will be given all opportunity to explain your situation and your innocency and there may not be any penalty if the adjudicating authority is convinced with your reasons.

Further, in future you may take care by filing the return well before the last date . What happens is people wait for the last day to file return and if in the last minute some technical problem occures they get in unnecessary problem, so take care and file ur return well in time, it  is n ot necessary to file your return on the 10th day, rather 10th is the last day.

With regards

Neeraj

If there is any technical fault occurs while filing the e-return then manual return should be filed with the jurisdictional Range Office with a covering letter stating reason for filing of manual return instead of e-return. Further, Range official cannot refuse to accept the manual return if there is any geniun reason for the same, provided return must be submitted with in prescribed time limit.
