Does private companies fall within preview of Employment exchange Act 1969  for filling quarterly return ?

Compulsory notification of vacancies may extend to private establishments; verify applicable state notification and local employment exchange. The Act mandates that public sector employers furnish prescribed vacancy information and returns to employment exchanges; for private sector establishments the appropriate government may, by notification, require similar furnishing of returns for specified classes of private establishments, with the form, content and intervals to be prescribed. Applicability for a given private employer depends on whether a state or competent authority has issued a notification covering that establishment, so employers should check the relevant notification or consult the local employment exchange. Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959

 

 

5. EMPLOYERS TO FURNISH INFORMATION AND RETURNS IN PRESCRIBED FORM. -

 

(1) After the commencement of this Act in any State or area thereof, the employer in every establishment in public sector in that State or area shall furnish such information or return as may be prescribed in relation to vacancies that have occurred or are about to occur in that establishment, to such employment exchanges as may be prescribed.

 

(2) The appropriate Government may, by notification in the Official Gazette, require that from such date as may be specified in the notification, the employer in every establishment in private sector or every establishment pertaining to any class or category of establishments in private sector shall furnish such information or return as may be prescribed in relation to vacancies that have occurred or are about to occur in that establishment to such employment exchanges as may be prescribed, and the employer shall thereupon comply with such requisition.

 

(3) The form in which, and the intervals of time at which, such information or return shall be furnished and the particulars which they shall contain shall be such as may be prescribed.

I read this clause, my question is right now which companies are liable for this return?... Do an IT Co. requires to file this return?

It will be better, if you check this aspect from the concerned authority.  Further, you may check the relevant notification in this regard.

If your establishment is covered by Notified establishment then you are liable to furnish the return. Better check whether any notification is  in force in the concerned State covering your established in the terms of the said Act.

Dear Ms. Reshma,

 

Better you can contact local exchange office and try to figure you out. Once they say its applicable in your case, then ask for relevant notification.
