Eligibility Confirmed for Cenvat Credit on Service Tax for Sales Commissions; Refund/Exemption Options for Foreign Agents Available. A query was raised regarding the eligibility to claim Cenvat credit on service tax paid for commissions on sales through agents. Three responses confirmed that Cenvat credit is permissible as the expense relates to sales promotion. Additionally, it was noted that for service tax paid on commissions to foreign agents, options include seeking a refund under Notification 17/2009-ST or an exemption under Notification 18/2009-ST.
