TDS Claim-Income in Two Asst. year

Anup Kumar Grover

An assessee has income from Rent, and it has received advance rent, then the deductor of TDS deducted tax on advance rent u/s 194I.

As per 26 AS it fall in FY 2010-11, however, some income part is relevant for the asst. year 2011-12 and some for AY 2012-13. TDS Certificate is common for the whole year.

Then, how it be possible for  an assessee to claim TDS in its Income Tax Return. As in new form there is no option to carried forward TDS for subsequent year.

Please advice

TDS on advance rent: year-wise credit allocation requires rectification under section 154 to adjust TDS claim. TDS on advance rent appears in Form 26AS for the year the tax was deducted, but the underlying receipts may relate to two assessment years; a single TDS certificate cannot be split in the return filing interface, and year-wise allocation must be corrected through rectification under section 154 to obtain proper TDS credit.
