Tax on salary arrears: declare lump sum salary and pay tax even if employer hasn't issued a tax certificate.
A government employee received lump sum salary arrears with no TDS deducted and the employer refused to issue Form 16; respondents advised that the absence of TDS explains non issuance of Form 16 and that the taxpayer must disclose the full salary income for the assessment year and pay the tax due, noting the drawing officer may issue the certificate in the subsequent year and that advance tax was not collected. (AI Summary)

Sir,

i am a government servant and i have not received my salary from 19-08 2010 for some reason and am now receiving salary from august 2010 to june 2011 at a time which is around 3.5 lakhs.am now paying my income tax around Rs 11000/- now in this paybill.is it correct to pay income tax now and my drawing officer is saying that he will not issue Form 16. now and he will issue it in the next year. how should i file my resturns to the IT dept without Form 16.

Dear Mr. Madhu

Your Unit did not deducte TDS/TCS in respective year against salary so your unit did not privide form 16 and you are saying that i will pay 11,000/- income tax, it mean you books income from others so please show all over income in assessment year 2011-12
