ISSUANCE OF PROOF EXPORT

Proof of export can be accepted on shipping documents and Annexure 19 when BRC is delayed due to payment terms.
The exporter may obtain Proof of Export by submitting shipment documents (Bill of Lading, mate's receipt, airway bill, or customs attested ARE 1) together with Annexure 19 to the jurisdictional excise division; acknowledgement of Annexure 19 is treated as acceptance as Proof of Export. If the BRC is delayed due to payment terms under a letter of credit, the exporter should inform the division, request acceptance of the submitted documents, and undertake to furnish the BRC when available. We are working at a Merchant Exporter company in delhi-II. I have not received of BRC against the export. Now we have problem in issuing of proof of export against against the CT-1.  plz clarify that, is this possible to issuing P.O.E. without of BRC and what is the process. Thanks NS RAWAT

Exporter has to submit of Proof of Export like Bill of Lading/ Mate receipt or AWB, Custom attested ARE-1 etc along with the Annexure 19 to the Jurisdictional Excise Division.

Acknowledgement of Annexure 19 is treated as acceptance as Proof of Export.

To produce the BRC within 180 days from the date of export is not possible because of the receipt of Payment against the shipment under LC. It may take time.

If the division office is ensisting on this, then simply request them that this is not possible right now as the payment terms are like this (mention the reason ) and ask them to accept the proof of export based on the documents submitted by you and will provide the brc in due course.
