Goods imported for SEZ but clearance obtained for DTA clearance
GANESH IYER
WE HAVE FILED A BILL OF ENTRY AND PAID DUTY AND OBTAINED OUT OF CHARGE IN ONE CONSIGNMENT WHEREIN THIS WAS ACTUALLY MEANT FOR THE CUSTOMERS SEZ unit. WHAT IS THE PROCEDURE FOR DUTY REFUND AND TRANSFER OF GOODS TO SEZ??
Definition of imported goods excludes items cleared for home consumption, limiting duty refund and SEZ transfer options. Goods cleared for home consumption with duty paid and out-of-charge are excluded from the statutory definition of imported goods, which constrains the availability of import-specific relief, including duty refund and mechanisms to transfer the consignment to an SEZ.
