VAT on silvermixed jewelery

gupta nitin
what is vat on silvermixed jewelery, example if the base content of jewelery has 30%and rest is metal or is 50-50.and metal jewelery with semi precious stones.vat for delhi,up,haryana.
Classification of jewellery determines applicable VAT rates; use market recognition and seek departmental clarification when unclear. VAT treatment for silver mixed jewellery is driven by the article's classification under the relevant State VAT schedules; determine whether the item is recognized in trade as jewellery or imitation goods because that classification, not material percentages, dictates which scheduled VAT rate applies, and seek formal clarification from the VAT department where definitions or classification remain ambiguous. Rates may be referred to in the respective schedules as per the respective VAT Act and schedules thereof. I thing the real issue in it is regarding classification of the article. Whether it would fall under the category of Jewelery or articles of Gold, Silver and Precious Metals including Jewellery made from gold, silver and precious metals. In the absence of clear definition provided in the VAT, you need to follow the basis principal and that is how the market recognize the same in normal course of trade? Is is recognized as Imitation jewellery. In case of persistent you may get clarification from the VAT department.
