Good Evening all,

My Query is whether Rent not received but TDS deducted by the tenant on the rent receivable during the year need to be shown while computing Income tax under cash system of accounting in the hands of owner of the property? please suggest what has to be done in such type of case.

Rent not received but tax deducted: disclose in return when tax is paid or show and pursue recovery. Where a tenant has deducted tax at source but the landlord has not received rent in cash, practitioners advise declaring the rent in the year the TDS was paid/credited or disclosing the rent in the income tax return and pursuing civil or criminal recovery against the tenant. You need to book the income in the financial year in which TDS was paid.

You may pay show the rent for which tax is deducted but not given in cash in the income tax return.  You may take action to recover the rent from the tenant either by civil way or by criminal way.
