Is GST Payable on difference between FOB value and CIF Value of Exports

umeshkumar jhawar

Dear Experts

Our GST Audit has been condutected and in as per one of para officer has asked to pay GST on difference between FOB value and CIF Value of Exports.

We hvae booked Export in our books of Accounts at CIF value say Rs. 100000.00 and its FOB value as per ICEgate is Rs. 85000.00 , here officer is asking to pay GST on Rs. 15000.00 as same is not under Export giving reference to Refund Circular as issued by department.

GST Officer's Demand on Export Value Discrepancy Questioned; Legal Basis Under GST or Customs Act Unclear A forum participant raised a query about a GST officer's demand to pay GST on the difference between the FOB and CIF values of exports. The exports were recorded at CIF value, with a discrepancy of Rs. 15,000 between the CIF and FOB values. Respondents, including Amit Agrawal, Charu Tyagi, Kasturi Sethi, and Shilpi Jain, expressed skepticism about the officer's demand, noting the absence of legal provisions under GST or Customs Act for such a tax. They questioned the legal basis of the demand and suggested that the objection might lack substance, as no formal audit report or notice was mentioned. (AI Summary)
