GST ON REP Project

GST rates for mixed-use projects: commercial supplies taxed at higher rate, residential at lower rate.
Mixed-use projects must treat supplies by purpose: commercial units attract the higher GST rate and residential units attract the lower GST rate; input tax credit is available for the commercial portion and should be ascertained on the basis of carpet area; sales by the landowner of commercial units follow the same GST treatment. (AI Summary)

1. What will be the GST rate on Project where Commercial portion is 40% and residential is 60%?? Do we need to maintain separate books for availing lower tax rate??

2. What will be GST rate on the portion of Landowner sale of commercial part on the said project???

1.

Commercial units would be liable at 18%

Residential units at 5%

ITC will be available in respect of commercial units. This can be ascertained on the basis of carpet area.
