One of my client received notice for recovery of late fee of around ₹ 2 lakhs for delay in filing of TDS returns for f.y.2012-13. However as per my knowledge the STAY granted by Hon Kerala high court on recovery of such late fee pertaining to f.y.on or before 2015-16.

What is the position for this issue ?

Is any relief granted further by Hon court ?

Shall I file appeal or pay entire dues ?

Client Debates Appeal or Payment of 2 Lakh Late Fee for Delayed TDS Returns; Section 234E in Focus A client received a notice for a late fee of approximately 2 lakhs due to delayed TDS return filings for the fiscal year 2012-13. The client is aware of a Kerala High Court stay on such fees for fiscal years up to 2015-16 and seeks advice on whether to appeal or pay. One respondent, Dr. Mariappan Govindarajan, requested more details for case tracking, while another, CA Susheel Gupta, referenced a Karnataka High Court case, suggesting filing an appeal.
