Merger of UT of DD & UT of DNH - effect on Registration of existing Tax Payers under GST

Vinay Kunte

Dear Experts

The Tax payer who is registered presently under the UT of daman and Diu will no be a Tax Payer in the UT of Daman & Diu and Dadra & Nagar Haveli. Will the Tax Payer have to seek a fresh Registration under this New UT and apply for cancellation for the exiting Registration? or will his registration would also be transferred automatically to the new UT?

Taxpayers in merged Union Territories must cancel old GST registrations, obtain new ones, and transfer ITC per Notification No. 10/2020. A discussion was initiated regarding the impact of the merger of the Union Territories of Daman and Diu with Dadra and Nagar Haveli on the registration of existing taxpayers under GST. The main concern was whether taxpayers need to obtain new registrations or if their existing registrations would automatically transfer to the new Union Territory. One expert clarified that taxpayers must cancel their old registrations and obtain new ones, with the option to transfer their input tax credit (ITC) as per Notification No. 10/2020. Another expert raised a query about utilizing ITC if not transferred within the specified timeframe. (AI Summary)
