Dear sir,

The applicant is a doctor simultaneously running Medical shop does he eligible to opt for composition. as per the amended provision(w.e.f.1.2.2019) he may do so supply of services up to 5.00 lakh or 10% turnover which ever is higher but his consultancy i.e, supply of services may exceed 5.00 lakh per year apart from medical shop turnover. So to my knowledge not eligible for composition, he has to go for regular registration, kindly enlighten.

W.e.f.1 February, 2019, the suppliers shall be allowed to supply services to the extent of 10% of the turnover or ₹ 5 lakhs, whichever is higher.

For example ; If Composition dealer has turnover of 80 lakhs (goods), 10% works out ₹ 8 lakhs (and option is or 5 lakhs, whichever is higher). Higher is 8 lakhs and supply of services to the value of 8 lakhs is permitted. In other words, eligible for composition scheme. If his turnover is 40 lakhs, 10% works out to ₹ 4 lakhs and higher is 5 lakhs. Despite the turnover of 40 lakhs, supply of services to the value of ₹ 5 lakhs is allowed.
