AGRICULTURE CONSULTANT

RAHUL GAIKWAD

My client is Trading in Agriculture Pesticides and other goods and he is Reg under GST.

He also do a consultancy to farmers for their Crops like Grapes and other. He charged for consultancy to Farmers. So he is liable to pay GST as he is already GSTTIN holder.?

GST Applicability: Consultancy Services for Crops Exempt Under HSN 998611; Trading Agricultural Pesticides Subject to GST. An individual inquired about the applicability of GST for their client, who trades in agricultural pesticides and provides consultancy services to farmers. The first response suggested that consultancy services for crops are classified under HSN 998611 and are exempt from GST as they are considered support services to agriculture. However, it was recommended to seek an Advance Ruling for clarity. The second response confirmed that trading in agricultural pesticides is subject to GST. (AI Summary)

In my view, consultancy to farmers for crops falls under HSN 998611 and is exempted. It is support service to agriculture. However, to be on safer side you should apply for Advance Ruling.
