CAN I CLAIM BRAND FIXATION OF DUTY DRAWBACK IF I IMPORT RAW MATEIAL UNDER MEIS LICENSE

KULDEEP SINGH

Dear Team,

We are planning to purchase MEIS Script and we are claiming brand rate of fixation duty drawback on few of our export products now we want to import all raw material under MEIS Script , can we claim brand rate of fixation if we import raw material under MEIS Script

Debate on Duty Drawback Eligibility for MEIS License Imports: Conflicting Views on Claiming Brand Rate of Fixation A participant in a discussion forum inquired about the possibility of claiming a brand rate of fixation duty drawback when importing raw materials under the Merchandise Exports from India Scheme (MEIS) license. One respondent confirmed that payment through MEIS is valid for customs duty, and another agreed with this view. A third response clarified that the brand rate of duty drawback is allowed for goods imported and used in manufacturing exports, with CENVAT credit on CVD and SAD permissible if duties are paid through MEIS. However, another participant disagreed, stating that claiming such a drawback is not possible. (AI Summary)

Brand Rate of Duty Drawback is allowed on the goods imported and in-turn used in manufacturing of goods which exported out of India. Even CENVAT credit on CVD and SAD is allowed if the duty on imported goods is paid through .MEIS
