Cenvat credit on freight and insurance

RAM SHARMA

Dear Experts,

Whether a manufacturer can take cenvat credit on freight and commission given to our consignment agent in gst draft law just like as current service tax law. Pl clarify.

Thanks & Regards

Cenvat credit eligibility for freight and commission depends on final GST provisions, not on current service tax practice. Whether a manufacturer may avail cenvat credit on freight and commission under the proposed GST depends on the final GST provisions defining input services and allowable credits; current service tax treatment should not be presumed to carry forward, and taxpayers should await the final legislative text before taking a definitive position. GST law is not in final shape. Any change can occur. Please await till that time.

I learned from reliable source that final draft would be made available to public by end of this month.

Dear Experts,

As per my opinion, we should discuss present revised GST Draft Law so that we could prepare for upcoming chages.

Thanks & Regards

Discussing of Current Model GST Law will surely prove a good foundation to check the various transaction which will have the impact on business. However, until unless final law do not come till then a final view cannot be taken.

Ganeshan Kalyani on Feb 15, 2017

Sir, talking on draft model GST law will be futile if the final gst law is different from the present one. The original draft law in comparison with revised model GST law is different. More provision were changed. Same may happen. Thus it is advisable to wait till final law to come in place.
