Clarification on Cenvat credit for capital goods during exemption period; export to Nepal under LUT requires proof in six months. A user inquired about availing Cenvat credit on capital goods received during an exemption period and the documentation required for exporting to Nepal under a Letter of Undertaking (LUT) with payment in INR. Respondents advised reviewing Rule 6(4) of the Cenvat Credit Rules, 2004, and noted that exports to Nepal are treated like exports to other countries, requiring proof of export within six months from clearance. The department may extend this period upon request. Another respondent confirmed the advice, and a third mentioned that availing 50% credit in a subsequent period is permissible, referencing relevant judgments. (AI Summary)
