CENVAT CREDIT

ASHISH KUMAR

HELLO ,

WE IMPORTED A MACHINE IN DECEMBER 2015 ( AGAINST ZERO DUTY EPCG SCHEME ). Now we want to surrender our epcg license , after paying all the duty ( customs , excise ) plus Interest

After paying it , we want to take the cenvat credit ( for the excise component ). Is it allowed ? - (we are a manufacturer and registered with excise)

If yes , against which document ( as the Bill of Entry shows zero duty ) ??

Manufacturer Seeks CENVAT Credit for Excise Duties After Surrendering EPCG License; Guidance Needed for Zero Duty Entry A manufacturer imported a machine in December 2015 under the zero-duty EPCG scheme and now intends to surrender the EPCG license after paying all applicable customs and excise duties, plus interest. They seek to claim CENVAT credit for the excise component but are unsure how to proceed since the Bill of Entry shows zero duty. One respondent advises claiming CENVAT credit on GAR-7 with a copy of the Bill of Entry and detailed customs duty documentation. Another suggests exploring the possibility of fulfilling the Export Obligation (EO). (AI Summary)
