Dear Sir,

Please explain in simple way regarding the Press release regarding the Customs SWIFT enables importers/exporters to file a common electronic‘Integrated Declaration’ on the ICEGATE portal.

Integrated Declaration replaces Bill of Entry, simplifying filings but creating Cenvat credit eligibility uncertainty under Rule 9. The Bill of Entry has been replaced by an Integrated Declaration filed electronically on ICEGATE that consolidates declarations for multiple authorities. CBEC has issued a circular/public notice with details. The change simplifies filings but creates uncertainty for claiming Cenvat credit because Rule 9 of the Cenvat Credit Rules, 2004 specifically names the Bill of Entry as the eligible document; amendment or clarificatory guidance from the Board is anticipated. Dear Friend,

From 01.04.2016, the Existing Bill of Entry is renamed as Integrated Declaration which contains, all the required declarations required to be filed before different authorities including Drug Control agency posted in the Csutome House which are all these need to be filed separately in addition to the Bill of Entry which is a welcome step.

In this regard, CBEC issued instruction by way of either circular or a Public Notice with all the details and you may refer the same in ICEGATE / or CBEC website.

Wioth this integrated declaration, though the process made simple, the importers going to face an issue with regard to availing Cenvat Credit of CVD and SAD paid on the imported goods because under Rule 9 of CCR,2004 Bill of Entry is specified as an eligible document for taking cenvat credit. Now from April,2016, there is no Bill of Entry and in view of this , let us hope the Board will amend the provisions of Rule 9 of CCR,2004.
