Export to Germany-Certificate of Origin

Hello

We export the goods to Germany. So we have to provide Certificate of Origin i.e.Form A (GSP) to them.

We applied for GSP & then the the final copy of Airway bill received.

So there is a difference of 51 kgs in gross weight which is mentioned in GSP/Invoice & Airway bill

Can this create an issue for importing the goods in Germany for our buyer?

Please guide.

Certificate of Origin discrepancy may affect preferential duty claims but not necessarily import clearance where goods were actually received. A fifty-one kilogram discrepancy between the gross weight on the Certificate of Origin (Form A, GSP) and the airway bill affects administrative and commercial aspects of preferential tariff claims but does not inherently prevent import clearance where the goods were actually exported and received. If invoice net weight and value match the buyer's order, remittance and sale price are aligned; however, a reduced declared quantity at import can impact the importer's duty relief claim under GSP. Exporters should retain weighing and shipping records and may notify carriers of alleged negligence, while recognising that pharmaceutical imports are routinely inspected and tested on receipt. In case the goods have been actually exported ( i.e. left India) to Germany, I think there should be no problem in Germany. You will receive the foreign exchange (sale price of exported goods) as per actual quantity of goods received by your buyer in Germany.

I would also like to know what are the goods to be exported or exported to Germany ?

Nothing untoward is going to happen in Germany on account of difference of 51 Kgs.

GSP form mention clearly shortage of 51kg, than there is not any problem. genrally GSP form is menat for getting the relef of custom duty. if your value is correct than I think there is no any hurdle for you, only your remittance will come less against your export invoice.

difference is in the gross wt.that is mentioned on GSP & on airway bill.

net weight on invoice is the same for which our buyer has placed an order & value is also same.

so remittance will not be less.

The goods exported by overseas countries are duly weighed , at times at the port of import or during transport from port and invariably at the time of physical receipt of the goods by the importer.

Hence, if the goods are correctly weighed at time of export, then nothing to worry. However, you may issue letter to the airways for negligence on their part.

Even otherwise, pharmaceutical goods are duly verified, checked and tested at the country of import.
