EPCG machinery

Mithilesh Kumar

Dear sir,

We have import machineries under EPCG in 2011-2012 with 3.08 % of custom duty.

These machineries were using as per agreement taken during EPCG license.

Please advise can we use these machinery for rental business now.

Use of EPCG Scheme Machinery for Rental Limited Until Export Obligation is Fulfilled Under Actual User Condition A query was raised regarding the use of machinery imported under the EPCG scheme in 2011-2012 with a 3.08% customs duty. The individual inquired whether these machines could now be used for rental purposes. Two responses were provided: one stated that until the export obligation is fulfilled and the Export Obligation Discharge Certificate (EODC) is submitted, the machinery cannot be used for rental. The other response emphasized that the import of capital goods is subject to the Actual User condition until the export obligation is completed. (AI Summary)

Till the time you don't fulfill the export obligation and submit the EODC, you cannot use machinery imported under EPCG Scheme.

Sir,

Import of capital goods shall be subject to Actual User condition till export obligation is completed.
