Man power service

S.C. WADHWA

Dear Expert,

We are paying loading and unloading charges to our workers as well as outsider at our factory as well as at godown. We are not including this amount in GTA service while paying service tax.

Now my query is whether this amount fall under man power service and service tax to be paid under 100%reverse charge service. Please give your expert opinion.

Regards,

WADHWA

Service Tax on Loading and Unloading: When Does Reverse Charge Apply to Manpower Services? Key Compliance Insights. A user inquired about the applicability of service tax on loading and unloading charges paid to workers and outsiders, questioning if it falls under manpower services and requires payment under the 100% reverse charge mechanism. Responses clarified that if payments to outsiders are for manpower supply, they should be treated as such, and service tax may be applicable. It was suggested that these charges should not be recorded as freight if their nature is loading and unloading. The need for compliance with reverse charge provisions and proper accounting practices was emphasized, including potential implications under ESI laws. (AI Summary)
