Cenvat Credit of Excise can be utilised against the Liability of ST

Mehul Pandya

We have constructed a warehouse for renting purpose and we have paid the excise duty on the Products used for construction of the same. can we avail the credit of the same for our service tax Liability??

Also we have filled the return for the period of April to Sep and we have not availed the credit for the same period and now we want to revise the return., please clarify from which period we can avail the Cenvat credit as we know as per Budget 2014 only 6 months Cenvat can be Availed.

Thanks

Cenvat credit usability: excise paid on construction materials may offset service tax; revise returns if limitation not expired. Cenvat credit of excise duty on products used in construction of a rented warehouse can be utilized against service tax liability. If returns were filed without claiming such credit, a revised return may be filed to avail the credit provided the statutory limitation period for revision has not expired; Budget 2014 introduced a shorter retrospective window for availment. You can utilize the credit on payment of service tax. Revised return is to be filed within 90 days from the date of filing. If the limitation period of 90 days has not expired you may file the revised return.
