Companies Can Claim ADC and CVD Credits on Pre-Registration Capital Goods per Cenvat Credit Rules A user inquired about the eligibility to claim CVD and ADC credits on capital goods imported before their company was registered with the Excise Department. The response confirmed that the company is entitled to claim credits for capital goods acquired prior to registration. Specifically, the user can avail 100% of ADC credit and 50% of CVD credit in accordance with the cenvat credit rules. The response cited favorable tribunal decisions supporting this entitlement.
