of <h1>Finance (Amendment) Act, 1987: No Penalties for Missing 5% Surcharge on TDS from Dec 16, 1987, to Jan 2, 1988.</h1> The Finance (Amendment) Act, 1987, effective from December 16, 1987, mandates a 5% surcharge on tax deducted at source for certain payments to Indian residents and domestic companies. Despite its enactment on December 16, media announced it only on January 2, 1988. Consequently, some organizations did not apply the surcharge for payments made between December 16, 1987, and January 2, 1988. It has been decided that these entities will not face penalties, interest, or prosecution for this oversight. All relevant officers should be informed of these instructions.
