of <h1>CENVAT Credit on Light Diesel Oil: Supreme Court Decision Accepted; Circular No. 784/17/2004-CX Withdrawn; Adjudicate Pending Cases.</h1> Circular No. 812/09/2005-CX, dated 22/03/2005, addresses the CENVAT Credit on Light Diesel Oil stock as of 28/02/2003. It refers to a previous circular instructing that show cause notices on this issue be held pending until the Supreme Court's decision on the department's Special Leave Petition (SLP). The Supreme Court has since decided on the SLP, and the decision has been accepted by the Board. Consequently, Circular No. 784/17/2004-CX is withdrawn, and pending cases should now be adjudicated based on the Supreme Court's ruling. Receipt of this circular must be acknowledged.
