Spices in Appendix 4J subject to pre-import conditions; DFIA imports prohibited regardless of intended end use
The Directorate clarifies that all spices listed in Appendix 4J are subject to pre-import conditions and therefore are ineligible for import under Duty-Free Import Authorisation (DFIA). Appendix 4J's S.No.1 and its subcategories merely set differing export-obligation periods (EOPs) for Advance Authorisations based on specific permitted uses (e.g., manufacture of oils/oleoresins, value-addition activities); other uses fall under a residual category with a six-month EOP. Because every spice entry in Appendix 4J carries pre-import restrictions, DFIA import of spices is prohibited irrespective of intended end use, and authorities must enforce compliance.
