<h1>Visakhapatnam Customs sets new rules for coal and coke clearance; penalties apply for shortages beyond 2% u/s 116.</h1> The Office of the Principal Commissioner of Customs in Visakhapatnam issued guidelines to address difficulties in the discharge and clearance of dry bulk cargo, specifically coal and coke, after the grant of Out-of-Charge (OOC). An independent survey report, countersigned by a Customs Officer, is required to ascertain the actual cargo unloaded. Customs duty is based on the draft survey report, with a permissible shortage of up to 2% of the manifested quantity for coal and coke. Shortages beyond 2% require explanation, failing which penalties under Section 116 of the Customs Act, 1962, may be imposed. Delivery of cargo does not require a Customs NOC if shortages or excesses are within 2%.
