Foreign Vessels Beyond 12 Nautical Miles from Indian Coast Exempt from Marine Shipping Act Licensing Requirements.
The Government of India has amended Circular No. 53/99-Customs to clarify that foreign flag vessels leaving Indian ports and proceeding beyond 12 nautical miles from the Indian coast are not required to obtain a license under Sections 406 or 407 of the Marine Shipping Act, 1958. These sections pertain to vessels engaged in coasting trade. Therefore, vessels heading to locations beyond India's territorial waters, such as platforms or drilling rigs, do not need specific permissions. Relevant authorities are instructed to disseminate this update through public notices or standing orders, and any implementation issues should be reported to the Board.
