This decision, informed by a Supreme Court judgment and consultation with the Ministry of Law, clarifies that while such societies are not 'body corporates,' they are recognized as 'persons' with separate legal entities, capable of company membership under section 41(2). Consequently, the interpretation of 'body corporate' in various Companies Act provisions should exclude these societies. This modifies the previous departmental stance communicated in 1957.
