Analysis: The disputed goods and the cleared CTD Bars/M.S. Rounds emerged from the same stream of raw material, and the earlier final order had already recorded that the raw material had not suffered duty. In that situation, the condition precedent for availing the exemption under the notification was not satisfied, and the dropping of the demand on ferrous waste and scrap could not be sustained.
Conclusion: The exemption was not available and the demand on ferrous waste and scrap was liable to be confirmed.
