At the same time, the lower authority had not examined the marketability aspect in the manner required for classification, nor had it dealt with the applicable rules for interpretation of the tariff schedule. Since those foundational aspects were not considered, a fresh examination was necessary.
Conclusion: The classification issue was not finally determined and the matter was required to be reconsidered by the original authority after hearing the assessee.
Final Conclusion: The impugned order was set aside and the dispute was sent back for de novo determination of classification.
