Issue (i): Whether the appellants were entitled to exemption under Notification No. 175/86 or Notification No. 217/85 in respect of the seized diesel engine components.
Analysis: The goods were found seized from a tempo and were shown to be consigned to a buyer other than the alleged original equipment manufacturer. The certificates relied upon were only general certificates and did not specifically relate to the seized goods. The condition attached to the exemption for clearance to original equipment manufacturers was therefore not satisfied. As regards Notification No. 217/85, the benefit depended on compliance with the prescribed Chapter X procedure where the components were used elsewhere than in the factory of production, and that procedure was not followed.
Conclusion: The exemption under both notifications was not available to the appellants, and the duty demand was rightly upheld.
Issue (ii): Whether the penalty imposed required reduction.
Analysis: In view of the quantum of duty and the overall facts and circumstances, the penalty was considered excessive to the extent imposed.
Conclusion: The penalty was reduced.
Final Conclusion: The demand of duty was sustained, while the penalty was scaled down, resulting in partial relief to the appellants.
